These Terms & Conditions apply to all classes, courses, class packs, memberships, introductory offers, private lessons, workshops, events and other services provided by SKYRA Dance & Aerial Yoga (“SKYRA”, “we”, “us” or “our”).
By purchasing, booking or participating in any SKYRA service, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (“ACL”).
1. Bookings
All classes are subject to availability and advance booking is required.
A valid class credit, package, membership or other eligible booking entitlement must be available at the time of booking.
Bookings are personal to the registered member and must not be transferred, shared or resold unless SKYRA expressly permits otherwise.
SKYRA may impose reasonable booking limits for high-demand classes to ensure fair access for members.
2. 12-Hour Cancellation Policy
Class cancellations or rescheduling must be completed at least 12 hours before the scheduled class start time.
A cancellation made less than 12 hours before class is a Late Cancellation.
For class packs and introductory passes, a Late Cancellation will result in the relevant class credit being deducted as if the class had been attended.
Failure to attend a booked class without cancelling (“No Show”) will also result in the class credit being deducted.
For memberships that include a specified number of classes or otherwise permit bookings without individual class credits, SKYRA may record a Late Cancellation or No Show against the membership and may apply any clearly disclosed late-cancellation/no-show policy applicable to that membership.
The 12-hour policy applies regardless of personal scheduling conflicts, work commitments, transport delays, change of mind or other circumstances within the member’s control.
Nothing in this clause limits any rights available under the Australian Consumer Law.
3. Late Arrival
Members should arrive approximately 5–10 minutes before class.
For safety reasons, particularly for Aerial Yoga classes, members arriving after the warm-up or safety briefing has commenced may be refused entry.
Where entry is refused because of late arrival, the booking may be treated as a Late Cancellation or No Show and the class credit may be deducted.
This policy is particularly important for aerial classes because equipment setup, safety checks and warm-up procedures form part of the class.
4. Introductory / Trial Offers
Introductory, trial and promotional offers are available only to eligible new clients unless expressly stated otherwise.
Unless the specific promotion states otherwise:
• introductory passes are limited to one per person;
• they are non-transferable;
• they must be activated and used within the advertised validity period;
• they cannot be frozen, paused or extended;
• unused classes expire at the end of the stated validity period; and
• late cancellations and No Shows count as used classes.
Promotional and introductory pricing cannot generally be combined with another promotion unless expressly stated.
5. Class Packages
All class packages have a clearly stated validity period commencing on the date specified at purchase or activation.
Members are responsible for booking and using their classes before expiry.
Unused class credits do not automatically roll over and packages are not automatically extended because the member was unable to attend sufficient classes before expiry.
6. Package Freeze
Eligible standard class packages may be frozen once only during the original validity period, subject to SKYRA’s applicable freeze conditions.
A freeze request must:
• be submitted before the package expires;
• be requested in writing;
• specify the requested freeze period; and
• be approved before the freeze takes effect.
A freeze cannot ordinarily be applied retrospectively.
Introductory passes, trial offers, promotional passes, complimentary credits and expired packages cannot be frozen unless SKYRA expressly agrees otherwise.
SKYRA may publish package-specific minimum or maximum freeze periods.
7. Package Extensions & Renewal
Packages are designed to be completed within their stated validity period and extensions are not ordinarily available.
Where a member wishes to continue training after their package has expired or is approaching expiry, SKYRA may offer the member the opportunity to purchase a new qualifying package.
At SKYRA’s discretion, remaining eligible unused credits from the previous package may then be given an extended redemption period in connection with the new purchase.
Any such arrangement:
• is discretionary;
• may be subject to minimum renewal requirements;
• does not constitute a permanent extension of the original package; and
• does not create an entitlement to future extensions.
8. Expired Credits
Once a package reaches its expiry date, any remaining credits will ordinarily expire.
Expired credits have no cash value and cannot ordinarily be transferred to another member or converted into another service.
SKYRA may, at its discretion, reactivate eligible expired credits as part of a qualifying package renewal or other approved arrangement.
9. Refunds
SKYRA does not provide refunds solely because a member:
• changes their mind;
• changes work or personal schedules;
• moves away;
• fails to use classes within the package validity period;
• misses or late-cancels a class;
• prefers another instructor or class;
• no longer wishes to participate; or
• purchases a package that they subsequently do not fully use.
However, nothing in this policy excludes or limits any refund, cancellation or other remedy a consumer is entitled to under the Australian Consumer Law.
10. Transfers
Class packs, memberships, credits, promotional offers and introductory passes are personal to the purchaser and are non-transferable, unless expressly approved by SKYRA.
Members may not sell, share or transfer account access or class credits.
Guest Passes may only be used in accordance with the specific conditions applicable to that Guest Pass.
11. Class Changes & Instructor Substitution
Class schedules, instructors, rooms and programming may change from time to time.
SKYRA may substitute an instructor where reasonably necessary.
An instructor substitution does not, by itself, entitle a member to a refund or package extension.
If SKYRA cancels a class, the affected class credit will not be forfeited and will ordinarily be returned to the member’s account or an appropriate alternative will be offered.
Nothing in this clause limits rights under the ACL.
12. Minimum Class Numbers
SKYRA may cancel or combine a class where minimum attendance requirements are not met.
Where SKYRA cancels a class, affected members will have their applicable class credit returned and will not be treated as having attended or late-cancelled.
13. Waitlists
Where a class is full, members may join the waitlist where available.
If a place becomes available and the member is automatically added to the class, normal cancellation requirements may apply once the booking is confirmed.
Your booking system should make the notification mechanism clear so clients know when they have actually entered the class.
14. Aerial Yoga Safety
Aerial Yoga involves physical activity performed using suspended equipment and carries inherent risks.
Participants must:
• follow instructor directions at all times;
• use equipment only as instructed;
• not attempt movements they have been instructed not to perform;
• inform the instructor before class of any injury, physical limitation or circumstance relevant to safe participation;
• stop participating and notify the instructor if they feel pain, dizziness, faintness or otherwise feel unsafe; and
• not participate while impaired by alcohol or drugs.
SKYRA may refuse or discontinue participation where an instructor reasonably considers participation unsafe.
15. Health & Fitness to Participate
Participants are responsible for assessing whether a class is appropriate for them and should seek appropriate medical advice where necessary.
Members must disclose information reasonably relevant to safe participation to the instructor before class.
Pregnancy, recent surgery, injuries and other circumstances may affect whether particular aerial movements or classes are appropriate.
16. Dance Classes & Physical Contact
Dance instruction may involve demonstrations, partner work and physical correction.
Where appropriate, instructors may ask permission before hands-on correction.
Members should tell the instructor if they do not wish to receive physical corrections.
17. Children & Minors
Participants under 18 must have consent from a parent or legal guardian.
Additional conditions may apply to children’s classes, including age requirements, supervision, collection procedures and behavioural expectations.
Parents and guardians must provide accurate emergency contact information.
18. Personal Belongings
Members are responsible for their personal belongings.
To the extent permitted by law, SKYRA is not responsible for loss, theft or damage to personal property unless caused by circumstances for which SKYRA is legally responsible.
19. Clothing, Jewellery & Equipment
Participants must wear clothing suitable for the relevant class.
For Aerial Yoga, members may be required to:
• remove jewellery, watches or sharp accessories;
• avoid clothing containing zippers, sharp hardware or other items capable of damaging aerial equipment; and
• comply with hygiene and clothing requirements notified by SKYRA.
A member may be refused participation where clothing or accessories create a safety risk or risk damaging equipment.
20. Damage to Studio Property
Members must use SKYRA’s premises and equipment responsibly.
Where a member intentionally or negligently causes damage beyond ordinary wear and tear, SKYRA may seek reasonable compensation for the actual loss caused, subject to applicable law.
21. Behaviour & Studio Etiquette
SKYRA is committed to providing a safe and respectful environment.
Harassment, bullying, discrimination, threatening behaviour, deliberate disruption, inappropriate conduct toward staff or members, or unsafe use of equipment will not be tolerated.
SKYRA may refuse entry or terminate participation where reasonably necessary to protect members, staff or the studio.
Any cancellation or termination will be handled consistently with applicable consumer law.
22. Photography & Video
Photography and filming may occasionally take place for SKYRA’s social media, website, marketing or promotional purposes.
Participation in promotional filming should be based on appropriate consent.
Members who do not wish to appear in identifiable promotional material should notify SKYRA before filming.
For dedicated shoots, MV projects or commercial productions, separate image/video consent terms may apply.
23. Member Photography & Filming
Members must respect the privacy of other participants.
Photography or video recording must not unreasonably interfere with a class or capture other participants without appropriate consent.
Commercial filming requires prior permission from SKYRA.
24. Private Lessons
Private lessons require advance booking.
Unless otherwise stated, the 12-hour cancellation policy also applies to private lessons.
Late cancellation or No Show may result in the private lesson being treated as used.
Where SKYRA or the instructor cancels, the session will be rescheduled or an appropriate remedy provided.
25. Workshops, MV Projects & Special Events
Workshops, MV projects, performances, shoots, intensives and special events may have separate booking, cancellation, deposit and refund conditions.
Where separate event-specific terms are disclosed before purchase, those conditions apply in addition to these Terms.
26. Deposits
Where a deposit is required to secure a private booking, event, performance project, studio hire or other service, the applicable deposit conditions will be disclosed before payment.
A deposit may be non-refundable for change-of-mind cancellations where this is clearly disclosed and legally permissible, but nothing in the deposit terms limits rights under the Australian Consumer Law.
27. Promotions & Complimentary Credits
Promotional credits, complimentary classes, Guest Passes and campaign offers:
• have no cash value;
• cannot ordinarily be transferred or exchanged for cash;
• are subject to the stated campaign validity period;
• may be limited to one offer per person; and
• cannot be combined with other offers unless expressly stated.
Promotional terms will be disclosed with the relevant promotion.
28. Gift Cards
Gift cards are subject to applicable Australian gift-card laws and the specific terms stated at purchase.
29. Pricing
All prices are displayed in Australian dollars (AUD).
Any applicable GST will be handled as required by law.
SKYRA may change prices for future purchases from time to time.
A price change will not retrospectively change the price already paid for an existing package unless permitted by the applicable agreement and law.
30. Membership Rules
Where SKYRA offers recurring memberships, additional membership-specific terms may apply, including:
• billing frequency;
• class limits;
• booking restrictions;
• minimum term, if any;
• suspension;
• cancellation procedure;
• failed payments; and
• notice requirements.
These conditions must be disclosed before the member enters the membership.
32. Changes to These Terms
SKYRA may update these Terms from time to time for future purchases and bookings.
Where a change materially affects an existing member’s rights or obligations under an existing agreement, SKYRA will deal with that change consistently with applicable law.

Nothing in these Terms prevents a consumer from exercising any rights available under Australian law or contacting NSW Fair Trading or another appropriate body.
34. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot legally be excluded.
